Customer
will use the online service as a management
tool for its greeting project efforts
including:
a. Management
of participants’ information
b. Selections
by participants of other participants
c. Producing
letters and invoices
d. Tracking
of invoices and payments (not including
actual collection of funds)
Access to a dedicated website will
be granted until 30 days post the
greeting’s event

Provider
has no responsibility whatsoever for
any payment issues to Customers from
participants in the program, whether
these apply to checks, credit card
information for the Customer to process
or PayPalTM payments.

| 3. |
Provider uses
reasonable endeavors to ensure that
the service is available 24 hours
a day, 7 days a week. There will be
occasions, however, when the service
will be interrupted for maintenance,
upgrades and emergency repairs or
due to failure of telecommunications
links and equipment that are beyond
the control of Provider. Reasonable
steps will be taken by Provider to
minimize such disruption where it
is within the control of Provider.
Customer agrees that Provider shall
not be liable to Customer for any
modification, suspension or discontinuance
of the Service.

While Provider
shall make reasonable efforts to protect
and backup data for Customer on a
regular basis, Provider is not responsible
for Customer's files residing on Provider’s
website.

| 5. |
While Provider
shall make reasonable efforts to ensure
that Customer’s information
is secure on its system, no data transmission
over the Internet can be guaranteed
to be 100% secure. As a result, Provider
cannot guarantee the security of any
information Customer transmits, and
Customer does so at its own risk.

Customer’s
database of participants will not
be used by Provider, without written
permission, for any purpose other
than Customer’s own needs in
the context of the greeting project
nor will it be given to, sold to or
viewed by any third parties.

| 7. |
Provider reserves
the right to perform statistical analysis
of user behavior and characteristics.
|
| 8. |
Applicable Law
and Jurisdiction - These Terms shall
be governed by and construed in accordance
with the laws of the State of Connecticut.
Any disputes arising under or in connection
with the use of this software shall
be subject to the exclusive jurisdiction
of the state and federal courts of
the State of Connecticut. |
